Tobacco free does not mean outside tobacco law

This is the correction, and every page in this category implies the opposite.

Under UK rules, products made wholly or partly from tobacco, or from any substance used as a substitute for tobacco, are liable to Tobacco Products Duty. So a tobacco leaf wrap is caught, which surprises nobody.

The part that does surprise people: herbal smoking products that contain no tobacco at all are liable to Tobacco Products Duty in the same way and at the same rates as their tobacco equivalents. A herbal product for smoking is defined as a product based on plants, herbs or fruits which contains no tobacco and can be consumed by combustion. There is also a separate notification and labelling regime for herbal smoking products, made in 2017.

Whether an individual unfilled wrap falls inside that definition, rather than being handled as an accessory in the way a rolling paper is, is a question for the manufacturer of each product and not something we are going to assert line by line. What we can say is this: choosing hemp over tobacco removes the tobacco and the nicotine, and it does not place the product in some unregulated space outside the rules.
